Terms of IDnow Identification Service.

IDnow provides an identification service used to verify that an identity document has not been forged/fraudulent and that it belongs to the person who holds it.

The purpose of these Terms and Conditions of Use (“Terms”) is to set out the terms and of use of IDnow’s identification services (each individually “Identification Service” or jointly “Identification Services”).

The terms apply between IDnow and you (“End User”, “you”) for the use of the Identification Services.

Only natural persons may use the Identification Service.

1. Contracting Parties and Purpose

(1) IDnow offers its Identification Services to its partners (“Partners”) such as banks, telecom operators, payment institutions, insurers, online gaming companies, car-sharing services, entertainment platforms, etc. who wish to establish a business relationship or who already have a business relationship with You.

As a rule, these Partners must carry out such verification measures to comply with legal and regulatory requirements (in particular anti-money laundering legislation, the Telecommunications Act, the eIDAS Regulation, legislation on the protection of young people in the media, road traffic legislation) or to enhance the security of the identification of their users.
In this regard, IDnow acts as an independent identification service provider and provides the identification service on behalf of the Partner.

(2) IDnow does not make any transactions or payments between the Partner and You and does not act as an agent or mandatary for the Partner in any way. The contractual terms and conditions agreed between you and the respective partner apply exclusively to the services of the partner.

2. Availability of the Identification Service

Identification Services is accessible 24 hours a day, 7 days a week. However, this availability may be interrupted in the event of technical difficulties or force majeure. 

Maintenance can be carried out daily from 00:00 to 06:00 CET. We reserve the right to suspend, temporarily interrupt or modify access to all or part of the Identification Services without notice, in order to ensure their maintenance and/or control, or for testing purposes, without the interruption, suspension or modification giving rise to any obligation or compensation. We will endeavour to notify you in advance.

3. Identification process

The Identification Service is made available to the End User via a mobile application or a web application (the “Application”). As part of the verification process, the identity document is checked and, possibly, compared to the person’s face. 

By clicking on the “Start Identification” button or similar registration, you are making an offer to IDnow to enter into a relationship to use the Identification Services in accordance with these Terms. The acceptance of the offer is concluded by the actual execution of the identification service.

The different steps in the process are as follows: 

  1. From the Application, the user is invited to present an identity document to the camera of his smartphone or laptop. 
  2. The Identification Service carries out various checks on the photograph of the document captured by the User so that IDnow verifies that the document has not been falsified. The type and extent of the data collected depends on the requirements of the respective Partner and the legal requirements applicable to that Partner. Further information can be found in the policies of the Partner for whom you are performing this identity verification.
  3. Depending on the Partner’s needs, the End User may be asked to take a photo of their face or perform a facial recognition session from their smartphone or laptop camera. Photographs of the end-user’s face are taken. A video recording of the process can also be made.
  4. The Identification Service compares the photograph on the identity document with the photograph of the User’s face to ensure that it is indeed of the same person.
  5. The Partner may have added a manual verification to the automated verification. An IDnow specialist performs a series of checks on the items collected during the automated journey.
  6. The User may also be asked to provide and register additional documents (e.g. registration certificates, invoices from electricity, gas or telecommunications suppliers, pay slip, registration certificates) (“Additional Documents”) using the IDnow App. 
  7. IDnow transmits to the Partner the data collected during the identification process (usually photographs of the front and back of the identification document, a photograph of the End User, the data collected from the document). and, if applicable, a video recording of the identification process).

IDnow can only finalize the identification of the End User if all documents necessary for verification have been provided by the End User.

4. Artificial Intelligence

The identification service integrates a low-level Artificial Intelligence (AI) system in accordance with the AI Regulation 2024/1689 of 13 June 2024 in order to detect fraud. 

AI is implemented as part of the Identification Services for the following purposes:

  • Data control: Extraction and validation of the data contained in the document to detect any inconsistencies.
  • Tamper detection: Analyze submitted documents to identify tampering.
  • Selfie and Facial Recognition (if activated by the Partner): comparison of the photos of the document with photographs in real time in order to ensure their correspondence.
  • Repeat fraud (if activated by the Partner): detect reused identity fraud.

The User is informed when interacting with a Service based on an AI algorithm.

Any personal data processed in the context of AI is managed in accordance with the Privacy Policy and the General Data Protection Regulation (GDPR).

IDnow is committed to monitoring and controlling AI models to limit the risk of errors or bias.

5. Obligations of the End User

The End User is obliged to provide IDnow with all documents necessary for the provision of the Identification Service. In addition, the end-user is also required to ensure that no other person is identifiable during the identification process.

To use the IDnow App, you must have a suitable device (e.g. computer, smartphone or tablet) and a stable internet connection. If the End User wishes to use the Identification Service via a mobile device, this will only be possible by using the mobile application. The Mobile App is available for iOS devices via the iOS App Store function and for Android via Google Play. The End User is responsible for the performance and compatibility of the respective device.

The End User must keep the data provided by IDnow (e.g. transaction number and TAN) secret and protect it against use by unauthorised third parties.

The end user shall immediately inform IDnow of any suspicion of unauthorised use of their data by e-mail to the following address: fraud@idnow.de.

End User shall:

  • Do not share your password (if applicable)
  • Do not give them access to a TAN SMS sent to their mobile number
  • Notify IDnow without delay if an authentication factor has been compromised using the contact methods below

To ensure the safety of the process and the best possible experience, the End User must:

  • Use a camera that has a good enough camera to capture clear images of the document. A clear image means that the camera can capture an image of the ID document that clearly shows the text on the document and the background structure of the document.
  • Use the latest version of the app provided by IDnow or the partner
  • Make sure the device is up to date with the latest security patches provided by its vendor
  • If applicable: Make sure that the browser you are using is up to date with the latest version provided by its provider
  • Perform identification in a quiet environment with no external interruptions

6. Fees

IDnow provides the end-user identification service free of charge. IDnow receives remuneration from the Partner. All costs of connecting data to the Internet necessary for the use of the Identification Service are the responsibility of the End User.

7. Intellectual Property

The End User acknowledges IDnow’s intellectual property rights to the Identification Services, its components, the related content as well as the trademarks, logos, slogans, videos, photographs and waives the right to contest these rights in any form whatsoever.

8. Liability

IDnow, its legal representatives and vicarious agents are liable (i) in the event of wilful misconduct and gross negligence, (ii) injury to the life, limb or health of persons, (iii) fraudulently concealed defects and (iv) mandatory statutory provisions. 

Apart from the cases provided for above, IDnow is only liable for breaches of its essential contractual obligations and for direct and foreseeable damages arising from the contract. 

Essential obligations mean those obligations the performance of which enables the proper performance of the Agreement and on which the End User can rely. 

Unless otherwise provided for by mandatory law, IDnow’s liability is excluded.

The Identification Services and their Terms are governed by French law, regardless of the place of use. In the event of failure of amicable solutions or in the absence of their search, any dispute arising from these provisions may be brought before the competent courts
